The court went on to explain how to properly file the request the next time around. Most of the advice — and the mistakes the advice is meant to address — concerns basic filing errors. But the court also advised Trump’s team they needed to refile with the government’s consent or leave of court — and dinged the lawyers for not having leave of court, which means the court’s consent, in the first place."

    They might be doing this on purpose. They know that the filing is not going to work regardless, they are only doing it because Trump wants them to. So why put in all the effort to make it perfect? Especially when they know it is unlikely they are ever getting paid.

    Plus, this gives Trump an opportunity to say “I lost on a technicality”, implying he might have won otherwise.

      because pissing off the judge with a filing you’re not even allowed to file is a great way to lose future decisions too. The absolute most basic part of their job is to advise their client on proper court procedures- and to comply with them. If they can’t even do that much… they’re totally incompetent.
