Seems the French code gives more police powers than our constitution. Edit: they need something similar to what we’d call probable cause and I’d personally call it an arrest without charges https://www.sba-avocats.com/Criminal-defense-attorney-paris-france-police-custody-mobile.html They also have similar rights against self incrimination in France.
